Terms & Conditions for driving lessons with Go Ahead Driving

These terms explain how lessons are booked, paid for, cancelled and delivered. By booking, paying for, accepting or attending a lesson with Go Ahead Driving, you agree to the terms below.

Important Notice

Once you book, pay for, accept or attend driving tuition arranged through Go Ahead Driving, there will be a binding agreement between you and your Instructor for that lesson or those lessons.

  • Your acceptance of these Terms & Conditions and your lesson bookings may be recorded by Go Ahead Driving, your Instructor, or any booking platform used for lesson administration.
  • If the pupil is under the age of 18, the pupil’s parent or legal guardian agrees to be bound by these Terms & Conditions until the pupil reaches the age of 18.
  • These Terms & Conditions apply to the provision of driving tuition by driving instructors working with, or introduced through, Go Ahead Driving.

1. Driving Instructors

1.1 The Instructor may be a self-employed driving instructor and is not necessarily employed by Go Ahead Driving. As such, unless confirmed otherwise in writing, Go Ahead Driving is not a party to any separate contract that may exist between the Instructor and you.

  • 1.2 The Instructor should be registered with the DVSA as an Approved Driving Instructor (ADI) or, where applicable, as a Potential Driving Instructor (PDI).
  • The Instructor’s ADI or PDI registration should be up to date.
  • The Instructor should display their current DVSA ADI or PDI registration certificate in any vehicle used for a lesson, where required.

2. Booking & Payments

2.1 Lessons must be booked and paid for in advance unless agreed otherwise by the Instructor.

  • 2.2 Lessons may be paid for using a card or payment method belonging to a third party, for example a parent, guardian or family member. By booking a lesson, you confirm that you are authorised to use the payment method provided.
  • 2.3 The person who books the lesson and agrees to these Terms & Conditions remains responsible for all lesson fees, cancellation fees and any costs arising from chargebacks or payment disputes, regardless of who owns the payment card.
  • 2.4 Go Ahead Driving will not accept responsibility for any act, default or failure by an Instructor to carry out their obligations where the Instructor is acting as a self-employed instructor.

2. Booking & Payments Continued

2.5 You must pay your Instructor’s fees for all lessons within 48 hours of a lesson booking being accepted, unless your Instructor agrees otherwise. Lessons are usually paid for on an hourly basis or as an agreed lesson package.

  • 2.6 Current lesson fees may be obtained from the Go Ahead Driving website, booking page, or directly from your Instructor. Lesson prices may fluctuate up or down due to market conditions, availability, location, lesson type or instructor schedule.
  • 2.7 All new pupil bookings will be charged at the current price. Existing pupils will be charged at the current rate when prepaid lessons have been used and new payments become due, unless agreed otherwise.
  • 2.8 Any advance payments made for lessons are made on the understanding that those lessons should normally be taken within 3 months of the payment being accepted, unless agreed otherwise in writing.
  • 2.9 Payments may be made in advance directly to your Instructor by debit or credit card, online payment link, booking platform, electronic bank transfer, or another method agreed with your Instructor. Some instructors may accept cash, but this must be agreed directly with the Instructor in advance.

3. Driving Lesson Cancellations

3.1 You may cancel or rearrange a lesson without charge by giving your Instructor at least 48 hours’ notice before the scheduled lesson time.

  • 3.2 If you cancel or rearrange a lesson with less than 48 hours’ notice, the full lesson fee will remain payable. This is because the lesson time is reserved exclusively for you and cannot usually be filled at short notice. You agree that this cancellation policy is fair and reasonable.
  • 3.3 This charge represents a reasonable fee for the reserved time slot and is not a penalty.
  • 3.4 In exceptional circumstances, for example illness, accident or bereavement, your Instructor may choose, at their sole discretion, to waive the late cancellation fee.

4. Payment Disputes & Chargebacks

4.1 Any payment dispute or concern should first be discussed directly with your Instructor. If the issue remains unresolved, you should contact Go Ahead Driving by providing full details of your complaint.

  • 4.2 By booking a lesson, you agree not to initiate a chargeback or payment dispute for valid late-cancellation fees.
  • 4.3 If a chargeback or payment dispute is raised and the fee is found to be valid under these Terms & Conditions, Go Ahead Driving or your Instructor may seek to recover the outstanding amount and any associated costs.

5. Your Driving Lessons

5.1 A lesson will only be made available to you if the lesson is pre-booked and paid for in advance, unless agreed otherwise. You should book a lesson with the Instructor in person, by telephone, through the website, through a booking platform, or by another agreed method.

  • Following an initial booking, it is your responsibility and the Instructor’s responsibility to agree all matters relating to each future lesson, including date, time, location and duration.
  • 5.2 In the interest of productivity and benefit, 2-hour lessons may be recommended because they allow more repetition and experience of varied road conditions.
  • The Instructor will assess and agree the most suitable lesson length for you. The minimum length of a lesson will usually be 1 hour, and if you and the Instructor agree, it may be increased by increments of 30 minutes.

5. Your Driving Lessons Continued

5.3 Your initial booking with an Instructor may be subject to change due to operational or diary demands, for example another pupil booking a test at that time.

  • 5.4 Your Instructor has the right to cancel any booking made if they feel that they are unable to fulfil your lesson requests or driving test requirements.
  • 5.5 Go Ahead Driving may not accept online lesson bookings for pupils who have a practical driving test already booked less than 4 weeks from the date of the first lesson.
  • This is to allow a thorough assessment of the pupil’s ability, and to allow sufficient time for further lessons to be taken, or, if necessary, for the test to be cancelled or postponed before the DVSA statutory 10 working day cancellation period without losing the test fee.
  • The Instructor has a duty of care, so use of an Instructor’s car for your test will only be allowed if they believe you are safe and ready to take the test.
  • Go Ahead Driving does not provide a car for test without assessment and structured learning in advance.
  • Lesson bookings made without 4 clear weeks’ notice leading up to a test may be cancelled and refunded, unless agreed in writing in advance.

5. Lesson Requests & Refunds

5.6 Any specific requests for future lessons will be for the Instructor to accept or decline at their discretion.

  • 5.7 If an Instructor decides, due to your individual needs, that they are unable to accept your initial booking and commence your lessons, they should inform you within 24 hours of you making the booking and payment where reasonably possible.
  • 5.8 A refund for any payment made for any declined lesson should be actioned within 24 hours of the booking and payment being made where reasonably possible.
  • Payments made by debit or credit card, online payment provider or booking platform may take 3 to 5 working days, or longer depending on the payment provider, to be processed.
  • 5.9 Any other information about tuition or services of Go Ahead Driving or its Instructors may be found on the company website. You should take this information into account when deciding to book a lesson or making any decision about tuition or services.

6. Your Instructor’s Responsibilities

6.1 The Instructor will reserve any lesson slots or guarantee regularity of lessons over any period of time or on any particular date and/or time only once payment has been received in advance of the booking.

  • Nevertheless, the Instructor shall use reasonable endeavours to make regular lesson slots available to you.
  • These slots will not be secured or guaranteed bookings unless payment is received in advance.
  • 6.2 If the Instructor wishes to cancel a lesson, they may do so without incurring liability to you, and you will not have to pay for that lesson.
  • This may be due to the Instructor’s illness, unavailability of a suitable vehicle, unsafe conditions, or another reason beyond the Instructor’s reasonable control resulting in them being unable to provide the lesson fully or properly.
  • If the lesson is cancelled in such circumstances, the Instructor will refund or credit your account in full for any advance payment made for that lesson, or reschedule the lesson.

These terms are designed to protect the learner, the Instructor and the lesson time that has been reserved.

6.3 Fitness To Drive

If the Instructor has reason to believe that you are not fit to drive at the time of the lesson due to alcohol, drugs, prescribed or non-prescribed medication, illness, fatigue, medical condition, eyesight concern or another safety factor, they may cancel the lesson without notice in the interest of safeguarding, health and safety.

  • It will be at the Instructor’s discretion either to charge you for that lesson or not to do so.
  • In deciding whether to charge you, the Instructor should act reasonably.

6.4 Delayed Starts

The Instructor shall use reasonable endeavours to start a lesson at the time booked. However, the start may be delayed by unforeseen circumstances, such as bad traffic.

  • If there is a delayed start, the Instructor should add the lost time to the lesson.
  • If that does not suit you, the Instructor should add the time to a subsequent lesson or refund a pro-rata part of the fee for the lost time.

6.5–6.6 Communication

6.5 Your Instructor may send a message to introduce themselves, confirm the cost of future lessons and provide details of how to pay them directly for future lessons.

  • You may reply and contact your Instructor directly through the agreed communication method.
  • 6.6 As an existing customer, when booking future driving lessons directly with your Instructor, you may receive a notification of the bookings, and the bookings may be logged on the agreed booking system if one is used.

6.7 Meeting Location

The Instructor will agree the meeting location for each lesson with you at the time of booking.

  • The Instructor may choose a different location to conduct the lesson if additional travel is required in the interest of road safety.
  • If you wish to be picked up and taken to that location by the Instructor, travel time may form part of the lesson time.

6.8–6.13 Instructor Standards

6.8 The Instructor shall record payments in a suitable way and send you an electronic receipt if requested, where available.

  • 6.9 The Instructor shall, at all times, use reasonable endeavours to provide driving instruction at the agreed lesson times.
  • 6.10 The Instructor shall use reasonable endeavours to train you to a high standard, but shall not be responsible for any errors or traffic offences made by you.
  • 6.11 The Instructor shall be professional and courteous towards you and other road users.
  • 6.12 The Instructor shall act in accordance with the DVSA Code of Practice for Approved Driving Instructors.
  • 6.13 The Instructor shall act in accordance with the law.

7. Learner Responsibilities

7.1 You must be able to read a vehicle number plate from the legal distance before entering the vehicle, with or without eyesight correction.

  • The legal eyesight requirement is normally to read a number plate from 20 metres, or 20.5 metres for an old-style number plate.
  • If you cannot read a number plate at the prescribed distance, this means you may not be legally allowed to drive the vehicle.
  • Your Instructor may provide a theory lesson only, or the lesson may be forfeited at the full rate.
  • You should ensure that you have an eye test and any required eyesight correction well in advance of the lesson.
  • You must also ensure that your eyesight has not deteriorated before attending a driving test.

7.2 Licence Details

You may be asked by your Instructor to provide your driving licence details and an online share code via GOV.UK.

  • You must bring your photocard driving licence to your first lesson for the Instructor to inspect for insurance purposes.
  • Failure to provide your licence details or photocard may result in the lesson not going ahead.

7.3–7.5 Learner Cancellations

7.3 You may cancel a lesson without charge if you give the Instructor at least 48 hours’ prior notice of the cancellation.

  • If you give the required notice, any sum paid in advance for that lesson should be refunded or credited.
  • 7.4 If you do not give the Instructor at least 48 hours’ prior notice of cancellation, the Instructor will be entitled to charge you for any net financial loss suffered due to your cancellation.
  • 7.5 If, due to exceptional circumstances including illness, accident or bereavement, you cancel without giving at least 48 hours’ prior notice, the Instructor will consider the circumstances and may try to fill that time slot with another pupil if time allows.

7.6 Lateness

If you know you are going to be late for a lesson, you should contact the Instructor to tell them as soon as possible.

  • If the Instructor is unable to contact you more than 15 minutes after the scheduled start time, the Instructor will try to provide the lesson where possible.
  • If the Instructor decides that they cannot do so, the lesson may be treated as cancelled without notice by you.
  • The Instructor may decide to charge for that lesson as cancelled without notice.

7.7–7.8 App & Legal Conduct

7.7 As a new customer, you may receive a message or invitation containing a link to access any booking app, portal or platform used by Go Ahead Driving or your Instructor.

  • When you first use that system, you may be asked to accept these Terms & Conditions.
  • 7.8 You must act in accordance with the law at all times while on a driving lesson.

8. Vehicles & Insurance

8.1 Your Instructor shall ensure that all vehicles provided for lessons are fitted with dual controls where appropriate, are fully roadworthy, taxed, have a valid MOT where relevant, and are fully insured for the purposes of driving instruction.

  • 8.2 You may request to use your own vehicle.
  • Whether you use your own vehicle is for the Instructor to decide at their sole discretion.
  • You must provide proof to the Instructor of your vehicle’s roadworthiness, tax, valid MOT where relevant, and suitable insurance for the purposes of professional driving instruction.

9. Driving Tests

9.1 The Instructor shall discuss driving tests with you and shall inform you when they feel that you are ready to take a test.

  • 9.2 You shall be responsible for booking theory and practical tests.
  • It is your responsibility to check the details of the test on your DVSA confirmation email.
  • It is recommended that you forward a copy of the confirmation email to your Instructor to help eliminate mistakes and confusion.
  • 9.3 You must check with the Instructor before booking to ensure that the Instructor considers you ready for a test.

9. Test Details & Documents

9.4 You must inform the Instructor of all details of your test, including the date and location, at least 10 working days before your test date.

  • 9.5 When you attend a test, you must take all required documentation with you.
  • If you do not take the required documentation, your test may be cancelled.
  • You may then lose your DVSA test fee as well as the fee paid to your Instructor for their time.

9.6 Test Vehicle Availability

If the Instructor has given you permission to use their vehicle for your test but it breaks down or is otherwise unavailable or unusable on the date of the test, the Instructor shall use reasonable endeavours to arrange an alternative vehicle.

  • If this is not possible, your Instructor shall pay for the replacement test where required by these Terms or agreed in writing.

9.7 DVSA Cancellation

If your test is cancelled by the DVSA giving you insufficient time to provide the Instructor with the required cancellation notice of a booking, you must still pay for the Instructor’s time and/or the use of the Instructor’s vehicle.

  • In that case, the Instructor may advise you on claiming compensation from the DVSA for the cost of those fees.

9.8 Refusal Of Vehicle For Test

If you have a test booked and, in the Instructor’s opinion, you do not make the expected progress in your lessons between the date of booking and the test date, the Instructor may refuse use of their vehicle for your test.

  • The Instructor should inform you of this decision in writing in advance of the DVSA cancellation period where possible.
  • Your Instructor and Go Ahead Driving will not be responsible for any DVSA test fees that you lose in these circumstances.

10. Cancellation & Termination

10.1 The Instructor may, at their sole discretion, terminate your tuition if your conduct, progress or commitment consistently falls below the standards that the Instructor reasonably expects.

  • 10.2 You may terminate your tuition at any time.
  • However, any lessons booked within 48 hours of that time will still be charged for.
  • Your Instructor shall refund any unused fees for lessons that you have paid in advance, subject to valid deductions under these Terms & Conditions.

11. Liability

11.1 Your Instructor will be responsible for any foreseeable loss or damage that you may suffer as a result of breach of these Terms & Conditions by the Instructor or as a result of the Instructor’s negligence.

  • Loss or damage is foreseeable if it is an obvious consequence of the breach or negligence, or if it was contemplated by you or the Instructor when the contract was created.
  • Go Ahead Driving will not be responsible for any loss or damage caused by a self-employed Instructor unless required by law.
  • 11.2 Nothing in these Terms & Conditions is intended to exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.

11.3 Consumer Rights

If you are a consumer as defined by the Consumer Rights Act 2015, or a consumer for the purposes of any other consumer protection legislation, nothing in these Terms & Conditions is intended to exclude, limit, prejudice or otherwise affect your legal rights or remedies.

12. Changes To Terms & Conditions

12.1 Go Ahead Driving may, from time to time, change these Terms & Conditions without giving you notice, but will use reasonable endeavours to inform you as soon as reasonably possible of any such changes.

13. Data Protection

13.1 In so far as providing and administering tuition and any other services for you involves Go Ahead Driving or your Instructor collecting, using, holding or otherwise processing personal data obtained from you, including but not limited to your name and address, this should only be done with your consent or another lawful basis and in accordance with applicable data protection legislation.

  • Your rights under data protection legislation should be respected.
  • Personal data may be used for lesson administration, booking, communication, payment, safety, training records and related purposes.

13.2–13.4 Recordings & Marketing

13.2 Some instructors may have video equipment recording the exterior and/or interior of the car during lessons for the purpose of training and safety.

  • 13.3 Some instructors may request to take a photograph of their pupils once their test has been passed.
  • 13.4 By agreeing to these Terms & Conditions and giving any required consent, you may give permission to your Instructor and Go Ahead Driving to use photographs and/or video recordings of you for marketing and promotional materials, including social media, the company website and printed publications.
  • You understand that you can withdraw your consent at any time by contacting Go Ahead Driving.

14. Regulations

14.1 Go Ahead Driving is required, where applicable, to ensure that certain information is given or made available to you as a consumer before a contract is made with you, except where that information is already apparent from the context of the transaction.

  • Relevant information may be included in these Terms & Conditions for you to see now.
  • Relevant information may also be made available to you, or by the Instructor, before a lesson booking is accepted.
  • All such information will, where required by applicable regulations, be part of the terms of the contract with you as a consumer.

15. Complaints

15.1 Where instructors are self-employed and working with Go Ahead Driving, they remain responsible for their own tuition and actions unless the law provides otherwise.

  • 15.2 In the first instance, the matter should be resolved directly between the pupil and the Instructor.
  • 15.3 If the matter cannot be resolved between the pupil and the Instructor, Go Ahead Driving nevertheless wants to hear from you. You should contact Go Ahead Driving with full details of your complaint.
  • 15.4 Your complaint will normally be acknowledged within 3 working days, and following investigation, a satisfactory outcome or decision on how to resolve the dispute will normally be reached within 28 days where reasonably possible.
  • 15.5 Whilst reasonable endeavours are used to ensure a high standard of tuition and service, Approved Driving Instructors are self-employed, responsible for their own actions, and are regulated and governed by the DVSA.
  • 15.6 If you have any complaint about tuition or other services provided by any Instructor, or any other unresolved complaint, you may refer unresolved disputes to DVSA customer services.

How to raise a concern

If there is a problem, please discuss it with your Instructor first. Most issues can be resolved quickly and fairly by speaking directly.

  • If the matter cannot be resolved, contact Go Ahead Driving with full details.
  • Complaints should normally be acknowledged within 3 working days.
  • Where reasonably possible, Go Ahead Driving will aim to provide an outcome within 28 days.
